Bill to Allow Temporary Liquor Licenses Passes House – League Amendment Added

Posted on October 1, 2012 by Dene Westbrook

HB 5488 passed the full House on Thursday.  The League testified on this issue back in the spring in committee and stated language should be added in the bill to assure that these temporary licenses are not subject to “takings” claims if they are revoked or if the permanent licenses are not issued. This language did not make it on at the committee level.  On Thursday, the League worked in the House lobby to try and get the amendment on the bill on the House floor.  After a rollercoaster of a night with having the amendment, then losing it, then having it again, the end result was a victory for the local communities when the amendment was added on and the bill passed the House towards the end of the evening.

We want to thank Rep. Franz (the sponsor of the bill) for putting this amendment on his bill for League members to help shield them from potential lawsuits. If you get a free moment, please thank Rep. Franz yourself (especially if he is your state representative) for his actions Thursday evening.
